Important information about using SPEAR's remote check-in service for home care.

CRITICAL: NOT OFFICIAL SERVICE DOCUMENTATION
SPEAR does NOT replace an official Electronic Visit Verification (EVV) or agency-mandated check-in system. SPEAR provides remote access to a dedicated phone. You remain responsible for using the required third-party app and following every applicable rule.
Using SPEAR does NOT constitute proof that you provided home care services. Failure to use your agency's official documentation system may result in non-payment for your work.
1. What SPEAR Is and Is Not
SPEAR IS:
- A remote check-in service for home care
- A dedicated phone kept at your designated check-in location
- A way to access that phone from your personal phone
- A remote connection to apps installed on the dedicated phone
- Connection and setup support for the SPEAR service
SPEAR IS NOT:
- An official Electronic Visit Verification (EVV) system
- A replacement for your agency's clock-in/clock-out system
- Proof of service delivery for billing or payment purposes
- Compliant with Medicaid/Medicare EVV requirements
- A substitute for any state-mandated documentation
- Accepted by insurance companies or government payers as verification
- A guarantee that an employer, agency, payer, or program permits remote use
2. Your Documentation Responsibilities
As a home care worker, you remain fully responsible for:
- Using your agency's official EVV system to record visit start and end times
- Completing all required agency documentation and care notes
- Following your agency's policies and procedures for service documentation
- Ensuring accurate record-keeping as required by your employer
- Complying with state and federal documentation requirements
Important: Payment Depends on Official Documentation
Your wages depend on proper documentation through your agency's official systems. If you fail to clock in/out using your agency's system and instead rely only on SPEAR, you may not be paid for your work. SPEAR cannot and will not verify that you completed your shift.
3. In-Home Device Placement
If you use a SPEAR device in a patient's home, you must understand and agree to the following:
Your Responsibility for In-Home Devices
- You are responsible for ensuring you have proper authorization to place a device in the patient's home (from the patient, family, and/or agency as required)
- You are responsible for the physical security and safety of the device
- You are responsible for ensuring the device does not interfere with the patient's living environment or medical equipment
- You are responsible for any damage to the patient's property related to the device
- SPEAR is not responsible for loss, theft, or damage to devices left in patient homes
Before Placing a Device in a Patient's Home:
- Obtain written consent from the patient or their legal representative
- Check your agency's policy on personal devices in patient homes
- Ensure the device location is safe and does not create a hazard
- Inform the patient about what the device does and does not do
- Keep a copy of any consent forms for your records
4. Patient Privacy
When using SPEAR in a home care setting, you must protect patient privacy:
Do NOT Use SPEAR To:
- Photograph, record, or document patient medical information
- Store protected health information (PHI) without proper authorization
- Share patient information with unauthorized parties
- Capture images of patients without explicit consent
- Access or store patient medical records
SPEAR is designed to provide remote access to the dedicated phone. Do not use SPEAR or the dedicated phone to photograph, record, or store sensitive patient health information unless you have proper authorization and a lawful reason to do so.
Violation of patient privacy may violate HIPAA regulations and could result in termination from your agency and legal consequences.
5. Third-Party Applications
SPEAR allows you to access apps and services on your SPEAR device. Regarding third-party apps:
- Your agency's EVV or check-in app may be installed on the SPEAR phone. The third-party app connects directly to its provider; SPEAR supplies the remote connection to the phone.
- SPEAR does not integrate with or have access to your agency's EVV data. We cannot see your clock-in times, visit records, or payroll information.
- Third-party apps have their own terms of service and privacy policies. We are not responsible for third-party app functionality.
- SPEAR does not guarantee acceptance. Your employer, agency, payer, program, or app provider may restrict or reject remote use. Confirm their rules before using SPEAR.
Note: If you use your agency's app on a SPEAR device, any issues with that app should be reported to your agency, not to SPEAR support.
6. Limitation of Liability
By using SPEAR for home care purposes, you acknowledge and agree:
SPEAR is not liable for:
- Lost wages due to documentation errors or failures to use official systems
- Employment consequences from improper documentation
- Loss or damage to devices placed in patient homes
- Any issues arising from third-party app usage
- Patient privacy violations resulting from your misuse
- Any claims related to the quality or verification of care services
- Failure to comply with your agency's policies or legal requirements
You agree to indemnify and hold harmless SPEAR Global LLC from any claims, damages, or expenses arising from your use of SPEAR in a home care context, including but not limited to claims from patients, families, agencies, or government entities.
7. Required Acknowledgments
Before using SPEAR for home care purposes, you will be required to acknowledge that you understand and agree to the following:
I understand that SPEAR is NOT a replacement for my agency's official EVV or documentation system.
I understand that SPEAR cannot and does not verify or prove that I provided home care services.
I understand that SPEAR does not guarantee my employer, agency, payer, or program permits remote use of its check-in system.
I am solely responsible for proper authorization and placement of any SPEAR device in a patient's home.
I understand that SPEAR is not responsible for lost wages, employment issues, or any claims related to my home care work.
